PROCEDURE - Terms & Conditions

ScribeDigital is the trading name for the transcription services offered to third parties by Hosted System Solutions Private Limited. Reference to ScribeDigital below is therefore taken to mean reference to Hosted System Solutions Private Limited.

1. Quality Assurance
ScribeDigital transcriptions are of the highest quality and meet a minimum standard of 98.5% accuracy. Customers will be advised at the time of collecting a text file if the sound file provided failed to provide sufficient sound or dictation quality to achieve this standard.

2. Delivery
Generally we will send the transcripts to you when ready and this will fall within the time shown as follows. Sound files dictated Monday to Thursday will be transcribed and available for collection within 24 hours; sound files dictated on Friday will be available for collection by noon local time on the following Monday. We operate 24/7, 365 days a year and we are therefore able to offer turnaround times to meet your requirements. All requirements for delivery will be agreed at the time of Registration with an agreed method for special one-offs.

3. Security
We will take all appropriate steps to protect your privacy whenever you provide sensitive information, be it through your dictation or in your payment method. We take all reasonable measures to protect your personal information in storage and we will not pass on your details to any third party without your permission with the exception of any legal requirements to do otherwise but we will do our utmost to inform you of any information passed to legal authorities.

4. Privacy
ScribeDigital is committed to protecting your privacy. We only use the information that we collect about you lawfully (in accordance with the UK Data Protection Act 1998). We do not use cookies to gather or store personal data. No persistent cookies are set during your download of ScribeDigital PC. 5. Data protection
ScribeDigital does not sell or loan to anyone its database of stored information. It remains the sole property of the company. All customer data is stored securely.

6. Payment Options
ScribeDigital at the moment cannot accept credit card payments. Payments are to be made by bank transfer to the bank account appearing on the invoice. Interest of 1.5% may be added to outstanding accounts for every calendar month or part thereof that the account remains unpaid.

7. Taxes and Duties
These remain the responsibility of the customer or recipient in the country of destination.

8. Reservation of Title
Transcripts remain the property of ScribeDigital until paid for in full.

9. Collection
ScribeDigital asks that customers collect and pay for transcribed texts within the agreed terms. Uncollected text files may be deleted, and a charge raised for the appropriate number of pages. Each file will be charged at the prevailing rate.

10. Claims for Loss or Damage
We will not accept liability for any consequential losses, which may be claimed. ScribeDigital and/or its suppliers are not liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of ScribeDigital, with the delay or inability to use the service, the provision of or failure to provide services, or for any information, products, services, or otherwise arising out of the use of ScribeDigital services, whether based on contract, tort, negligence, strict liability or otherwise.

11. Price and Print Errors
Whilst we make every effort to ensure that all details published are correct, no responsibility will be accepted for errors and omissions. We reserve the right to alter specifications and prices without notice.

12. Incomplete Information
ScribeDigital cannot be held responsible for any orders which are unable to be processed due to incomplete or missing information, nor can we accept responsibility for transcriptions which are wrongly delivered or not delivered due to incomplete or erroneous information being given.

13. Liability
We warrant that the goods will at the time of delivery correspond to the description we have given.

14. Proper use
By making a purchase, customers agree to use ScribeDigital only to send and receive material that is proper. By way of example, and not as a limitation, customers agree that when using ScribeDigital, they will not:
    - Defame, abuse, harass, threaten or otherwise violate the legal rights (such as
      rights of privacy) of others.
    - Falsify or delete any author attributions, legal or other proper notices.
    - Violate any code of conduct or other guidelines, which may be applicable.
    - Violate any applicable laws or regulations.

15. Disclosure and access
ScribeDigital has no obligation to monitor your transcriptions. However, ScribeDigital reserves the right to review materials and to terminate your access to any or all services at any time without notice for any reason whatsoever.

16. Applicable law
In the unlikely event of any dispute by either party, please note that we are governed by Indian Law.

ScribeDigital may link to trusted third party sites. We accept no responsibility for their content.
